This dissertation includes four chapters: the first
chapter discusses the status of 'manufacturing contract' in Sunnite and
Imamieh jurisprudence. The second chapter discusses about this contract
in the law of Iran and in this chapter the cases which 'manufacturing
contract' is in compliance with one of the kind of contracts are dealt
with. The third chapter discusses this contract in law of Egypt. Finally
the last chapter is about the legitimacy of this contract as well as
some of the relevant terms.
This contract is regarded as legitimate in the four
sects of Sunnite but in Imamieh jurisprudence it is not basically
mentioned accepts for words and expression.
Some kind of contracts of "manufacturing contract"
is in compliance but there are a few questions about the compliance of
adaptation.
In the law of Egypt this contract is by itself a
correct and legitimate contract.
It seems that some of the generalities of the
contract and case-law and the principle of in making contract to be
enough to testify the legitimacy of this contract is the case-law, so
the contract is concluded as final.
